Gemma Ltd v Gimson (No 2)

Nature of case:
This is the costs hearing of the litigation on contractor’s entitlement to repudiate and measure of damages already reported in Con LR. It concerned an attempt to obtain costs from individuals (sole director and company secretary) in respect of judgment given against their limited company. It was held that, although costs orders against non-parties were exceptional, here the decisions were taken and the case run and funded entirely by the individuals, so that a non-party order was made.
