Costain v Charles Haswell & Partners

Nature of case:
In a claim for breach of contract and negligence, the court had to determine whether to award prolongation costs due to delay resulting from the need to re-design foundations for a water treatment works. The court also had to consider the question of how to deal with amounts paid to settle construction disputes out of court when they are later included as part of a claim against another member of a project team.
