Gemma Ltd v Gimson

Citation: 97 Con LR 165 TCC

Nature of case:
This deals with the meaning of ‘completion’ and the contractor’s alleged entitlement to repudiate by ceasing work.  The most significant point is the measure of damages, which was held to include distress and anxiety.   The (residential) clients had suffered much more than the usual level of inconvenience as a result of the repudiatory breach of contract.
