Nature of case: The TCC considered whether to continue a short-term (without-notice) injunction which prevented the Defendant from entering into a framework agreement. Whilst the Court accepted there was a serious issue to be tried in relation to a number of deficiencies in the marking of bids, it decided that damages were an adequate remedy for the Claimant and that the balance of convenience favoured discharging the injunction.
