Charlie Banner QC is spoke at the Procurement Lawyers' Association's first ever webinar on Wednesday, 5 August 2020, at 4pm. The panel of speakers discussed “Sufficiently serious breach" and looked at the Supreme Court’s decision in Energysolutions three years on. They considered issues such as:
- whether views have changed as to the rights or wrongs of the Supreme Court’s conclusion on the sufficiently serious breach test;
- whether in practice the test makes any (material) difference to the outcome of procurement law challenges;
- whether there are any Brexit implications to the continued application of this test;
- the more general question of the availability of the remedy of damages and whether that should be made easier or more difficult to access under future legislation and if so why.
