Given our unparalleled experience in construction law matters, we are also able to offer specialist advice and advocacy services in relation to the professional negligence of solicitors, engineers, architects, surveyors, valuers and other property professionals and claims in relation to NHBC warranties. 

Types of disputes  

Members regularly deal with claims relating to subsidence (both mining and non-mining), landslips, flood and fire damage. 

One of our members’ specialisms is nuisance and trespass claims arising out of construction operations, where allegations include excessive noise and vibration or overhanging cranes. Members also regularly deal with dilapidation and other property damage claims.  

Barristers at Keating Chambers are now routinely instructed in Building Safety related claims, including appearances before the First-tier Tribunals. Members were instructed on opposing sides of the leading case on remediation contribution orders: Triathlon Homes v SVDP and Get Living.  

Members have extensive experience in party wall disputes and issues about rights to light, including injunctions in those fields. They also have considerable expertise in nuisance claims, including claims in both public and private nuisance, Rylands v Fletcher cases and tree roots claims.
