Nature of case: This was an adjudication enforcement case which involved the question of whether certain works constituted construction operations for the purposes of the HGCRA on a power generation site. Work which would be a construction operation but which was necessary for the full and proper assembly or installation of plant so that it would fulfil the purpose of power generation is exempt from the Act. The Act excluded work that was being carried out to a site that would in the future be power generation site. Link to Judgment
