Nature of case: In an adjudication dispute arising from non-payment under a refurbishment contract, the court held that, while a contract might prescribe when payment fell due, thus providing guidance on whether a claim was denied, it could not be determinative of the point at which a dispute arose: Amec Civil Engineering v Secretary of State (Vivian Ramsey QC, Simon Hughes QC, John Marrin QC, Sarah Hannaford QC) applied.
