By Judgment of 17 June 2019, Sir Anthony Edwards-Stuart lifted the automatic suspension on a procurement claim relating to the award of a contract for elective services at the Nottingham Treatment Centre.
The suspension was lifted on the basis that damages were an adequate remedy for the Claimant and the balance of convenience did not favour either party.
The Court concluded that the least irremediable prejudice would result from preserving the status quo – which was defined as allowing the handover to the successful bidder (Nottingham University Hospital Trust) to stand.
