Nature of case: The applicant subcontractor (‘C’) claimed outstanding professional fees in the total sum of £578,983.82, arising out of engineering and mechanical services work carried out for the defendants (‘D’) on numerous projects extending over many years. C applied for summary judgment of its claim against the respondent contractors and/or to strike out D’s defence. The court held that C was entitled to unpaid sums claimed against D where they had failed to file an amended defence as ordered and the original defence did not address the specific allegations in the particulars of claim. However D was given leave to defend the part of the claim that related to loss of management time incurred by chasing payment.
