First instance decision – Claimant was refused permission to re-amend its particulars of claim to add a new claim for the cost of replacing concrete floor slabs because it could have pleaded the proposed new argument much earlier in the proceedings, and granting permission would have caused significant delay and disruption to the proceedings that were already in substantial delay because of previous re-amendment applications.
