Nature of case: This case concerned a jurisdictional challenge to a Part 20 claim made by a defendant who was not a party to the original claim. The court held that CPR 20.2 does not confer any right on a non-party to join in existing proceedings in order to make a claim. A non-party ought to have applied under CPR 19.4 to be joined as a Part 20 claimant. The court would then determine the application by reference to CPR 19.2(2) and to any other objection to its jurisdiction that might have been raised.
