Nature of case: The case concerned the obligations of a turnkey contractor engaged to fabricate and install a meteorological mast as part of a programme to develop off-shore wind-farms in the North Sea.
Although weather had been a factor in difficulty of installation, the dominant cause of the failure to install the mast had been the contractor’s inadequate advice on sea-bed soil conditions.
