Nature of case: This is a case considering the time at which the civil engineering main contractor’s right to payment arose in a power station project in North Wales and whether (under ICE 6th) the issue of a certificate is a condition precedent to payment. The right to claim interest on a sum which should have been certified becomes statute-barred six years after accrual of the right.
