The case arose from a contract to construct an automotive facility in China. The employer brought a Part 8 claim against the Defendant (the main contractor) seeking a declaration that a subcontractor could make payment of more than £1 million into an escrow account, pending resolution of a dispute between the parties.
In light of the fact that (among other things) the subcontractor was a Chinese entity who was not a party to proceedings, the claim was dismissed.
