Citation: 1 Butterworths Company Law Cases 390 Ch. Div (adjudication enforcement)
Nature of case: The claimant sub-sub-contractors sought summary judgment for payment from the defendant sub-contractors.
The claimants had presented for payment a cheque paid to them by the defendant which was then dishonoured.
The defendant argued unsuccessfully that, at the time of issue of the cheque, no money was in fact due because of errors and contra-claims.
There was no sufficiently exceptional reason why a stay should be granted.
