Nature of case: The court had to determine whether an adjudication agreement is capable of being repudiated and what happens legally when a party who institutes a reference to adjudication does not want to go ahead with the nominated adjudicator. In particular, the court had to decide whether, if the party abandons that reference, it can go ahead with another reference for the same dispute.
