A sub-contractor was entitled to summary judgment to enforce an adjudicator’s decision to award it over £1 million in a construction dispute with the defendant. While the sub-contractor’s financial position had been impacted by the COVID-19 pandemic and the loss of the contract with the defendant, the defendant had not shown that it was probable that it would be unable to repay the judgment sum if it were ordered to do so in future. The threshold for establishing special circumstances justifying a stay of execution had therefore not been met.
