Nature of case: Already reported in CILL, this decision concerned chiefly claimability of interest. The cause of action for these purposes would be the breach of the obligation to comply with the adjudicator’s decision. Interest could only be claimed under s.35A of the Supreme Court Act in enforcement proceedings from the date that Vauxhall failed to honour the adjudicator’s decision.
