Nature of case: Claim by a timber frame supplier (C) against a hotel developer (D) for payment. D claimed that C was a sub-contractor and had no direct claim for payment after the insolvency of the main contractor. HHJ Coulson held that C had entered into direct negotiations and contractual arrangements with D both before and after the insolvency of the main contractor, which entitled C to payment from D.
