Nature of case: This case provides important guidance on the construction of joint names insurance provisions and rights of subrogation. Lord Justice Rix found that the employer’s contractual right to be indemnified by the contractor against losses caused by the negligence of the contractor was unaffected by other contractual clauses that provided for joint names insurance.
