Rachael O’Hagan (instructed by Eversheds Sutherland LLP) represented the Slovak Ministry of Transport in a recent ICC arbitration brought by Zero Bypass. The dispute concerned one of Slovakia’s largest ever infrastructure development contracts (1.7 billion euros) for the design, build, finance and operation of the south-eastern section of Bratislava’s ring road and a section of the expressway network linking the country’s east and west. Rachael and the team were successful in substantially reducing the consortium’s claim from some €112.5m to €38.5m and the Tribunal declined to issue a costs award.
